ASC Daily Briefing — September 16, 2026
Afternoon update (source-expansion pass): the morning run found nothing new from the standard feeds. A sweep of additional sources surfaced four items never captured in the standing Page or any prior briefing.
New Today
OAS CAHPS Q2 2026 data submission is due October 14, 2026 — 28 days out. OAS CAHPS is a mandatory ASCQR measure; a missed quarterly vendor submission carries the same 2-percentage-point payment-update penalty as a missed annual HQR deadline. Remaining schedule: Q3 2026 due January 13, 2027; Q4 2026 due April 14, 2027; Q1 2027 due July 14, 2027. Confirm your survey vendor has the Q2 (April–June) sample loaded. Outpatient Surgery Access Act of 2026 (H.R. 8091 / S. 4963) — the hospital market basket update for ASCs sunsets after CY 2026 unless Congress or CMS acts. CMS has updated ASC rates with the productivity-adjusted hospital market basket since 2019 under a trial that expires at the end of 2026; absent action, the update reverts to CPI-U. H.R. 8091 (Van Duyne/Larson, introduced March 25) would make the market basket permanent and remove the ASC weight-scalar budget-neutrality adjustment; the identical Senate bill (Cassidy/Blumenthal, S. 4963) was introduced July 14. CMS-1850-P proposes to keep the market basket for CY 2027 (2.4% net), so practical exposure is CY 2028 onward — but the November final rule is where to confirm CMS extends it. Financial-model risk, not survey risk. Source: ASCA — Outpatient Surgery Access Act of 2026 · Congress.gov — H.R. 8091 · Rep. Larson — Senate companion
HHS-OIG issued two ASC-specific Advisory Opinions on March 9, 2026 (AO 26-03 and AO 26-04), both favorable. AO 26-04: a sole physician owner’s transfer of ASC ownership to a non-physician spouse (gift), physician children (FMV purchase options), and outside physician investors (FMV) as part of documented estate/retirement planning — OIG declined sanctions despite the arrangement missing some ASC safe-harbor elements, citing FMV pricing, pro-rata distributions, no referral linkage, and the retiring physician’s certification of no governance or referral role. AO 26-03: a device manufacturer’s discount on IOLs and cataract supplies to ASCs, conditioned on affiliated practices buying its software product — favorable. Practical use: AO 26-04 is the best current roadmap for physician-owner succession. Advisory opinions bind only the requestor. MedPAC’s March 2026 Report to Congress (Chapter 11) again recommends that the Secretary require ASCs to submit cost data. ASCs remain the only major Medicare facility type without cost reporting; MedPAC counts roughly 6,400 Medicare ASCs serving 3.4 million FFS beneficiaries in 2024, growing 2.2% per year. Repeated annually since 2010 and not adopted, but it is the standing argument for a future cost-report mandate and the data gap CMS cites when it declines to adjust the weight scalar. Watch item, no action. Source: MedPAC — March 2026 Report, Chapter 11
